Safe Harbor provisions provide a plan design option which allows plan sponsors a way to avoid the complexity of Section 401(k) non-discrimination testing and limited deferral opportunities for HCEs. Unfortunately, Safe Harbor provisions replace the complexity of testing with a new set of complicated rules and considerations. This webcast will provide an in-depth look at common complexities and a review of challenges which could arise due to this plan design choice. Topics include a discussion of the use of safe harbor provisions in cross-tested plans, the types of amendments that can be made mid-year, what happens if a notice is not provided timely (or at all), and plan terminations.

Robert M. Kaplan, CFP, CPC, QPA, APA
Bob Kaplan is the VP, National Training Consultant for ING. His responsibilities include webcast and live training for members of the TPA and Financial Advisor community as well as ING personnel.
He is currently a Co-Chair of the American Society of Pension Professionals and Actuaries (ASPPA) Government Affairs Committee. Bob is also a member of ASPPA’s Board of Director’s. He previously served as a member of the Board of Managers of the American Institute of Retirement Education (AIRE) as well as a member on the Board of Directors of the National Institute of Pension Administrators (NIPA).
In 2009, Bob was presented with NIPA’s Lifetime Achievement Award for his contributions to the retirement plan industry. Mr. Kaplan is a frequent speaker at industry events and has over 34 years of experience in retirement plan services, including plan design, administration, sales and consulting.
